Hart District Council’s Article 4 Direction for Employment Land
Hart District Council published a non-immediate Article 4 Direction which withdrew some of the permitted development rights on the most important employment sites in the District from 6th May 2019.
These proposals withdrew the existing permitted development rights related to the change of use of offices, light industrial units and storage and distribution units (currently permitted by Class MA, of Part 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) to residential use.
The reason for the Direction is the Council’s concern about the ongoing loss of employment land and the potential impact of the rights on business and economic growth since the office to residential rights were introduced in May 2013. The introduction of the Article 4 Direction would not necessarily prevent all changes of use but would require planning applications for them, meaning that the Council would have more powers to manage this issue.
