Project Overview

The proposal was for the demolition of the existing dwelling house and outbuildings, and the erection of a detached split level two storey house with additional accommodation within the roof space. The scheme also included alterations to ground levels to the front and rear.

The Council refused the application as they considered the new dwelling to be inappropriate development in the Green Belt, as well as raising issues of design, size and impact on neighbours.

Bell Cornwell acted as agents for the appeal process, drawing the Inspector’s attention to local precedents as well as setting out the case for what could be developed at the site under permitted development. The Inspector attached significant weight to this fall-back position in making her decision, setting out that the ability to construct a substantial outbuilding under permitted development formed the very special circumstances necessary to justify the development in the Green Belt.
